Two samples were forwarded to the U.S. Customs and Border Protection laboratory for analysis. Item no. FV-213577 (B) contains red chili rings, garlic stuffed green chili rings, and bay leaves, in a liquid medium. Item no. FV-213577 (C) contains red chili rings, green chili rings, garlic, rosemary sprigs, and kumquat peel cutouts, in a liquid medium. Item no. FV-213577 (A) contains red beans, mung beans, and bay leaves, in canola oil. Laboratory analysis found item no. FV-213577 (B) contained 4.21 percent acetic acid, and item no. FV-213577 (C) contained 3.96 percent acetic acid. Each of the items is put up in glass bottles measuring approximately 7-3/4 inches tall with a base measuring 2-1/2 inches by 5-1/2 inches.

Susan St. Santa Ana, CA 92704 RE: The tariff classification of preserved vegetables and fruit from China. Dear Mr. Gat: In your letter dated May 9, 2005, you requested a tariff classification ruling. Samples and illustrative literature were submitted with your letter. Two samples were forwarded to the U.S. Customs and Border Protection laboratory for analysis. Item no. FV-213577 (B) contains red chili rings, garlic stuffed green chili rings, and bay leaves, in a liquid medium. Item no. FV-213577 (C) contains red chili rings, green chili rings, garlic, rosemary sprigs, and kumquat peel cutouts, in a liquid medium. Item no. The rate of duty will be 2.1 cents per kilogram on the entire contents of the container. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
