OV-213573 (a) is comprised of sliced red and green chili peppers, and three bay leaves, in a liquid medium. Item no. OV-213573 (b) contains black beans, black-eyed peas, and three bay leaves, rosemary stems, and red-colored watermelon seeds as decoration, in canola oil. Item no. OV-213573 (c) contains red chili peppers, lavender, and bay leaves, in a liquid medium. Each of the items is put up in glass bottles measuring approximately 9 inches tall with a base measuring 2-1/4 inches by 1-3/4 inches. Laboratory analysis found item no. OV-213573 (a) contained 3.76 percent acetic acid. Item no. OV-213573 (c) contained 3.66 percent acetic acid.

Samples and illustrative literature were submitted with your letter. Two samples were forwarded to the U.S. Customs and Border Protection laboratory for analysis. Item no. OV-213573 (a) is comprised of sliced red and green chili peppers, and three bay leaves, in a liquid medium. Item no. OV-213573 (b) will be 2005.51.4040, HTS, which provides for other vegetables prepared or preserved otherwise than by vinegar or acetic acid, not frozen, other than products of heading 2006…beans (Vigna spp., Phaseolus spp.)…beans, shelled…other…other. The rate of duty will be 2.1 cents per kilogram on the entire contents of the container. This merchandise is subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
