Information was submitted with your initial request dated January 6, 2005. The subject merchandise is described as vegetable oil that has been used for deep frying in a food service facility. The waste vegetable oil contains mainly soy oil and canola oil with water and food particles. The water and food particles do not exceed 10 percent of the product. The waste oil has not been processed and is not edible. The product will be shipped to the United States by truck or rail, and will be used in the production of Biodiesel fuel. This merchandise may be subject to The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (The Bioterrorism Act), which is regulated by the Food and Drug Administration (FDA).
