Dear Ms. Stubblefield: In your letter dated March 8, 2005, you requested a tariff classification ruling. As requested, your sample will be returned. Style 617, which you refer to as a ”Volley Short,” is a pair of men’s shorts constructed from 100 percent polyester, woven fabric. The shorts have a tunnel elastic waistband with an inside drawstring; side seam, mesh fabric pockets; a small, unsecured pocket on the right front, inner waistband; a full liner of light weight knit fabric; and hemmed legs with side slits. Style 617 will be imported in men’s sizes S through 2XL. The rate of duty is 27.9 percent ad valorem. Style 617 falls within textile category designation 647.
