Dear Mr. Hoffacker: In your letter dated February 24, 2004, on behalf of Big Lots Stores, Inc., you requested a tariff classification ruling. You submitted a sample of a “Luminary Candleholders” assortment identified as assortment number HMC8016. The assortment consists of four tinplate candleholders that resemble trick or treat bags and measure approximately 3-1/2” in height x 2-1/2” in width x 4” in length. Each candleholder is decorated with cutouts (bat, spider, jack-o’-lantern, and witch’s hat) that are illuminated when a candle is placed in the holder.
