Dear Mr. Huang: In your letter dated September 15, 2004 you requested a classification ruling. The submitted sample, designated as TP2020, is a greige plain woven fabric composed of 100% non-textured filament polyester. It contains 7.9 single yarns per centimeter in the warp and 7.9 single yarns per centimeter in the filling. It has been constructed using 1000 denier non-textured filament polyester yarns in both the warp and the filling. Your correspondence indicates that the yarns that form this fabric have a tenacity of 68.87 centinewtons per tex. Weighing approximately 181 g/m2, this product will be imported in various widths ranging from 114 centimeter to 368 centimeters. The applicable subheading for the greige plain woven fabric will be 5407.10.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of synthetic filament yarn, including woven fabrics obtained from the materials of heading 5404, woven fabrics obtained from high tenacity yarns of nylon or other polyamides or of polyesters, other. The duty rate will be 13.6 percent ad valorem. This fabric falls within textile category designation 620. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
