Dear Mr. Register: In your letter dated September15, 2004, on behalf of Asia Pacific Resources, you requested a tariff classification ruling. The submitted sample, Ref. 465793, is a bib apron made of plastic material. The garment has a textile neck strap, piping and ties. The applicable subheading for the apron, Ref.465793, will be 3926.20.9010, HTS, which provides for “Other articles of plastics and articles of other materials of heading 3901 to 3914: Articles of apparel and clothing accessories (including gloves): Other, Other, Aprons.” The rate of duty will be 5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
