Dear Mr. Voth: In your letter dated August 17, 2004, you requested a tariff classification ruling. The merchandise to be imported is a bag stand for use in industrial and institutional locker rooms. The item is a floor standing support stand designed to retain a collection bag for soiled textile products. It would be used in commercial establishments for the purpose of collecting soiled towels, table linens, uniforms and other like items. The bag stand is made of steel sheet metal and measures 36 inches in height with a base of 18 inches by 18 inches. When not in use, the article can be folded flat for storage. The applicable subheading for the bag stand will be 9403.20.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other metal furniture, Other: Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
