The gift bag characters are permanently affixed to the bags and cannot be removed. The sandbags placed in the bottom of the gift bags enable the bags to stand upright on a shelf or mantle. Santa is an accepted symbol of the Christmas season and will be classified in Chapter 95 as a festive article. However, the snowmen are not considered to be symbols dedicated to the Christmas season. Therefore, the snowmen gift bag will be classified as other made up articles of textile in Chapter 63. The samples are returned as you requested.

Dear Mr. VerPault: In your letter dated July 23, 2004, on behalf of your client CVS Pharmacy, you requested a classification ruling.
