Dear Ms. Jones: In your letter dated July 23, 2004 you requested a tariff classification ruling. Items # NC2727, # NC2728 and # NC2729 Candle Gift Sets are identical except for color and fragrance and consist of a jar shaped glass candleholder with glass lampshade (approx. 6”H) and four tealight candles packed in a printed paperboard and folded plastic box. The blended wax is said to consist of less than 50% petroleum. The candleholder imparts the essential character of each set. The rate of duty is free. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
