Dear Ms. Chung: In your letter dated July 14, 2004, you requested a classification ruling. The submitted samples, Styles FFDN4634314 & FFDN4634314P, are pairs of women’s pants constructed from 62% polyester, 33% rayon, and 5% spandex knit fabric. The pants feature a flat elasticized waistband, slits at both sides, and hemmed leg openings. The applicable subheading for Styles FFDN4634314 & FFDN4634314P, will be 6104.63.2006, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear), trousers bib and brace overalls, breeches and shorts, of synthetic fibers, other, other, trousers and breeches, women’s, containing 5 percent of more by weight of elastomeric yarn or rubber thread. The rate of duty will be 28.2% ad valorem. Styles FFDN4634314 & FFDN4634314P fall within textile category designation 648. Based upon international textile trade agreements this category from Bangladesh is subject to quota restraints and visa requirements.
