Susan Street Santa Ana, CA 92704 RE: The tariff classification of preserved vegetables from China. Dear Mr. Gat: In your letter dated June 4, 2004, you requested a tariff classification ruling. The sample submitted with your letter was examined and disposed of. Item no. FV-207155A contains layers of yellow lentils, white beans, red beans, and split green peas, in canola oil. The peas and beans are put up in a twist-shaped glass bottle measuring 13 ½ inches tall and 2 inches square at the base. The applicable subheading for item no. FV-207155A will be 2005.90.9700, HTS, which provides for other vegetables prepared or preserved otherwise than by vinegar or acetic acid…other vegetables and mixtures of vegetables…other. The rate of duty will be 11.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
