Dear Ms. Wiebe: In your letter dated June 15, 2004, you requested a tariff classification ruling. The sample submitted with your request is a clear plastic case molded to incorporate plastic hinges and a plastic push lock closure. According to information on your website, this style, H92-6025-108-8813, is made of anti-static polyvinyl fluoride. Other mask packages are made of polycarbonate. The cases are used to ship a mask or reticle from a mask manufacturer to an integrated circuit manufacturer. You state that the packages are not meant for reuse. The applicable subheading for the plastic mask case will be 3923.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for the conveyance or packing of goods, of plastics: boxes, cases, crates and similar articles. The general rate of duty will be 3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
