Style number 1585 “Micro Suede Quarter Zip Windshirt”, is a man’s hip-length pullover garment constructed of a shell composed of a double knit 60% cotton/40% polyester fabric that measures 14 stitches per two centimeters counted in the horizontal direction. The garment is lined with a woven 100% nylon fabric. The pullover has a stand-up collar composed of a ribbed-knit fabric, a partial front opening at the neck secured by a zipper closure, long sleeves with ribbed-knit fabric cuffs, two side seam pockets at the waist and a ribbed-knit fabric waistband. Two samples were submitted as follows: Style number 1240 “Metro Microsuede Jacket”, is a man’s hip-length jacket constructed of a shell composed of a woven microsuede 100% polyester fabric. The jacket is lined with a woven 100% nylon fabric that is quilted in a diamond pattern to a nonwoven batting fill. The jacket has a full front opening that is secured by a zipper closure, long sleeves with an adjustable button closure on the cuffs, two front slash pockets at the waist and three inner pockets, two of which have zipper closures. The duty rate will be 27.7 percent ad valorem. The applicable subheading for the pullover will be 6110.30.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: men’s or boys’. The duty rate will be 32 percent ad valorem. The jacket falls within textile category designation 634. The pullover falls within textile category designation 638. Based upon international textile trade agreements products of Taiwan are presently subject to quota restraints and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
