Friedman Barnes, Ricahardson & Colburn 303 East Wacker Drive Chicago, IL 60601 RE: The tariff classification of an electronic controller board from Wales Dear Mr. Friedman: In your letter dated March 16, 2004, on behalf of Electrolux Home Products, N.A., you requested a tariff classification ruling. As indicated by the submitted information, the controller board is for use with washing machines and is populated with various electrical components such as fuses, surge protectors, transistors and capacitors. In operation, it serves to control the operation of the washing machine motor and the timer. The applicable subheading for the electronic controller board will be 8537.10.90, Harmonized Tariff Schedule of the United States (HTS), which provides for other boards, panels, …, and other bases, …, for electric control or the distribution of electricity, …: For a voltage not exceeding 1000 V. The rate of duty will be 2.7 percent ad valorem. You have suggested classification under subheading 9032.89.6085, HTS. This subheading is not applicable since the controller board does not meet the requirements of Note 7, Chapter 90, HTS. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
