Dear Ms. Morhardt: In your letter dated March 15, 2004, on behalf of Ethical Products Inc., you requested a tariff classification ruling. A sample was provided with your letter. The light tunnel (Article #8991) is marketed for use in a home aquarium. When the tunnel’s suction cups are placed near the filter the tunnel lights up via fiber optics. The lighting feature enhances the decorative effect of the tunnel. As you requested, the sample will be returned. The applicable subheading for the light tunnel will be 3924.90.5500, Harmonized Tariff Schedule of the United States, which provides for tableware, kitchenware, other household articles and toilet articles of plastics: other: other. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
