Dear Mr. Skillman: In your letter dated March 3, 2004, you requested a tariff classification ruling. The instant sample consists of a narrow flat braid measuring about 1/8 inch across. It is of a typical plaited construction where, in this case, several elastomer or rubber yarns are wrapped with textile. Specifically, you indicate in your letter that the material is composed of 57% elastomer and 43% nylon man-made fibers, by weight respectively. While the end use of this braid was not specified, it appears to be of a type that is utilitarian rather than decorative in nature. The applicable subheading for the braid will be 5808.10.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for braids in the piece, other, other. The duty rate will be 5.9 percent ad valorem. The rate of duty will be 4.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
