Box 612785 DFW Airport, TX 75261 RE: The tariff classification of a Musical Toy Giraffe from China Dear Mr. Sekin: In your letter dated March 11, 2004 you requested a tariff classification ruling, on behalf of Gemmy Industries Corp, your client. You are requesting the tariff classification on an item that is described as a Musical Toy Giraffe, item number 45246. The giraffe is battery-operated: when the ear is pressed it plays a musical song and moves its head. The giraffe will be imported with a carrying case that is specially designed to hold the toy giraffe. The proper classification will be in Chapter 95 of the HTS as other toys representing animals and its accessory (the carrying bag). You have not requested the return of your sample. The applicable subheading for the Musical Toy Giraffe, item # 45246, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures...and parts and accessories thereof: other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
