Massey Michaels 8000 Bent Branch Drive Irving, Texas 75063 RE: The tariff classification of Crayola Geo Draw and Travel Trace ‘n Draw from China Dear Ms. Massey: In your letter dated November 13, 2003, you requested a tariff classification ruling. Packaged samples were provided of the 841484, the Crayola Geo-Draw, and the 841485, the Crayola Travel Trace ‘n Draw. Per New York Ruling Letter J82040, April 10, 2003, the applicable subheading for the 841484 will be 9017.20.8080, HTS, which provides for “other” drawing, marking-out or mathematical calculating instruments (for example, drafting machines, pantographs, protractors, drawing sets, slide rules, disc calculators.) The rate of duty will be 4.6 percent ad valorem. Per J82040, the applicable subheading for the 841485 will be 9008.10.0000, HTS, which provides for image projectors, other than cinematographic; slide projectors. The rate of duty will be 7 percent ad valorem. The samples are being returned to you in a separate mailing. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
