Dear Mr. He: In your letter dated November 12, 2003, on behalf of US Jackson Products Inc., you requested a tariff classification ruling. Three samples of hard hat thermal liners, used to protect workers heads in winter were submitted with your request. Item 22294 has an outer shell made of woven 100% cotton fabric with a knit fleece lining. The liner has a textile chin strap and a textile fastener on each side of the liner. The second Item with red and blue fabric is hood-like style. It is made of knit polyester fabric with a ribbed knit at the neckline. The third item is a hood-like item that extends to the shoulder and has a hook and loop fastener closure at the neck. The applicable subheading for the hard hat liners will be 6507.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Headbands, linings, covers…for headgear.” The rate of duty will be Free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
