Massey Michaels 8000 Bent Branch Drive Irving, TX 75063 RE: The tariff classification of a photo holder from China Dear Ms. Massey: In your letter dated October 23, 2003, you requested a tariff classification ruling. The samples you submitted are three styles of a decorative stand that will be used to display photographs or pictures. The stands are composed of five steel wires extending vertically from a white polyresin base. Each wire forms a spiral at its tip to hold a picture. The bases are shaped like a butterfly (item number 21679), a heart (item number 21837), and a car (item number 21681), and will be decorated by the buyer after purchase. The applicable subheading for the picture holders will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornaments and parts thereof, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
