Dear Mr. Hall: In your undated letter received here on September 11, 2003, you requested a tariff classification ruling on behalf of Milton Adler Co. (Atlantic City, NJ). A sample of a “guest book” was submitted for our examination. It is a 6” x 8” hardbound book containing numerous blank paper pages ruled in a two-column format. Each page also has a printed heading that reads “Guests.” The cover boards are of rigid paperboard with an exterior surface of plastic film. The applicable subheading for the “guest book” will be 4820.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides, in pertinent part, for registers of paper or paperboard. The rate of duty will be free. We note that the sample is not marked with its country of origin. When imported into the United States, the item (or its immediate packaging) will be required to be so marked (e.g., “Product of China”), legibly, in a conspicuous place, and in a manner sufficiently permanent to reach the ultimate purchaser. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
