The inner layer is constructed from 100 percent acrylic, finely knit fabric that measures 20 stitches per two centimeters counted in the horizontal direction. Style HGM294CR features a self-fabric crew neckline; long, double layer sleeves; and a double layer body. The inner layer of the sleeves and the inner layer of the body extend approximately one inch below the outer layer. Both layers of the sleeves and the body are hemmed. The inside layer of the body also has side slits.

Dear Mr. Pascarella: In your letter dated August 3, 2003, you requested a tariff classification ruling on behalf of Presidio International, Inc. As requested, your sample will be returned. Style HGM294CR is a men’s pullover garment constructed from two free hanging layers that are securely attached at the neckband, the shoulder seams, the armholes, and the sleeve seams. The outer layer is constructed from 70 percent acrylic, 30 percent wool, jersey knit fabric that measures 18 stitches per two centimeters counted in the horizontal direction. The inner layer is constructed from 100 percent acrylic, finely knit fabric that measures 20 stitches per two centimeters counted in the horizontal direction. Style HGM294CR features a self-fabric crew neckline; long, double layer sleeves; and a double layer body. The inner layer of the sleeves and the inner layer of the body extend approximately one inch below the outer layer. Both layers of the sleeves and the body are hemmed. The inside layer of the body also has side slits. The applicable subheading for Style HGM294CR will be 6110.30.1550, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: containing 23 percent or more by weight of wool or fine animal hair: other: men’s or boys’. The rate of duty will be 17 per cent ad valorem. Style HGM294CR falls within textile category designation 438. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements and quota restraints. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts.
