CBP rationale
three-leaf clovers and sitting atop a circular-shaped resin base covered with three-leaf clovers. This base is incorporated with a receptacle for a tealight candle (not included). You state that this candleholder, designed for use on St. Patrick’s Day, should be classified under subheading 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles…other: other. However, since this item is not a three-dimensional representation of an accepted symbol, consideration of classification under subheading 9505.90.6000, HTS, is precluded. The applicable subheading for this decorative candleholder, item number 07330, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other.
