Maple Street Sutton, NE 68979 RE: The tariff classification of a dyed 100% nylon circular weft knit fabric from China. Dear Mr. Svoboda: In your letter dated April 30, 2003 you requested a classification ruling. The submitted sample, designated as “18 Tubing”, is a dyed weft knit fabric of rib knit construction. It is composed of 100% nylon and has been knit in tubular form with a diameter measuring approximately 46 centimeters. The fabric will be imported in 50 to 100 yard lengths and then cut and fabricated in the United States into collars for quilted utility jackets. The applicable subheading for the weft knit fabric will be 6006.32.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, of synthetic fibers, dyed, other. The duty rate will be 10.4 percent ad valorem. Based upon international textile trade agreements this product is not subject to either quota restraints or visa requirements when produced in China This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
