Dear Ms. Santos: In your letter dated April 9, 2003, you requested a classification ruling. The submitted sample is identified as item number 235057, Wire Garland. The garland is composed of wire with maple leaves attached. The maple leaves are made of metalized polyvinyl chloride (pvc) material. The wire garland has been wrapped with identical colors to match the maple leaves. The fall colored maple leaves are red and gold or red, gold and silver. Wire garlands of this type are considered one time use party decorations. The sample is returned as you requested. The applicable subheading for the wire garland will be 9505.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for confetti, paper spirals or streamers, party favors and noisemakers; parts and accessories thereof. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
