Dear Mr. Cochran: In your letter dated April 9, 2003 you requested, a tariff classification ruling. The literature you have submitted states that the Cordless Mobile Headset is a device, which allows for hands free and cord free cellular phone communication. The wireless communication between the cell phone and the headset is accomplished through blue tooth technology devices in the headset and phone. The headset consists of an earclip, a noise canceling microphone, a volume control, an LED indicator and a multifunction button to turn the headset on and off and answers and end calls. Bluetooth technology is a system which allows transmission and reception of RF signals between 2 dedicated sources. Thus radio signals are sent through the ether and not through wire connections. The headset will be packaged in retail boxes with a recharging case and an adapter. The applicable subheading for the Cordless Mobile Headset will be 8525.20.9080 Harmonized Tariff Schedule of the United States (HTS), which provides for Transmission apparatus for radiotelephony, radiotelegraphy, radiobroadcasting or television, whether or not incorporating reception apparatus or sound recording or reproducing apparatus; television cameras; still image video cameras or other video camera recorders; digital cameras: Transmission apparatus incorporating reception apparatus: Other … Other. The rate of duty will be free. The applicable subheading for the recharging case and power adapter, when imported separately, will be 8504.40.8500 HTS, which provides for telecommunications apparatus. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
