Dear Mr. Thompson: In your letter dated March 20, 2003, on behalf of your client Cubex Limited, you requested a tariff classification ruling. You have described your samples as pins, model numbers CM17006-1, CM45261-1 and CM45264. They are made of steel and perform a fastening function by connecting cylinders and other moving parts for use on drilling machines. The applicable subheading for all of the pins will be 7318.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: non-threaded articles: other. The general duty rate will be 2.8% ad valorem. Consideration was given to classifying your product in subheading 8431.43, HTS, as you have suggested, however, that classification was deemed inappropriate. Section XVI note 1(g) excludes parts of general use, as defined in note 2 to section XV, which would include articles of heading 7318. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
