The upper is, as you indicate, made of 100% nylon material, consisting of an approximately 1 ½-inch wide Y-configured thong strap with a sewn-on 1 ¼-inch square “Scuba Diving Flag” side patch. The ends of the upper penetrate and are secured to a molded rubber/plastic insole that is cemented to a wavy-type rubber/plastic outsole that varies in thickness from ¼-inch to 5/8-inch at different points around the perimeter of the outsole.

Dear Ms. Fenske: In your letter dated March 18,2003, you requested a tariff classification ruling. The submitted half pair sample, identified as a “Nylon Dive Thong Sandal,” is a unisex open-toe, open-heel, slip-on sandal. The upper is, as you indicate, made of 100% nylon material, consisting of an approximately 1 ½-inch wide Y-configured thong strap with a sewn-on 1 ¼-inch square “Scuba Diving Flag” side patch. The ends of the upper penetrate and are secured to a molded rubber/plastic insole that is cemented to a wavy-type rubber/plastic outsole that varies in thickness from ¼-inch to 5/8-inch at different points around the perimeter of the outsole.
