Dear Ms. Hodur: In your letter dated March 11, 2003, you requested a tariff classification ruling. The provided sample will be returned as per your request. The submitted sample, style S1069, is a soft bra constructed of a two ply knitted 95% cotton 5% elastane fabric. The garment features a rounded neckline, a T-back, “Calvin Klein” printed on the elasticized trim at the top edges and around the arm openings, side seams, and a 3/4-inch wide elasticized bottom. The applicable subheading for style S1069 will be 6212.10.9010, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of cotton. The general rate of duty will be 17 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
