Dear Ms. Lee: In your letter dated November 15, 2002, you requested a ruling on tariff classification. The sample you provided is a set of multipurpose flatware. The flatware consists of two pieces. The first contains a fork, corkscrew and bottle/can opener. The second contains a spoon, punch and knife blade. The merchandise may be imported separately, or together as a retail set. The applicable subheading for the fork/corkscrew/bottle-opener will be 8205.51.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for handtools (including glass cutters) not elsewhere specified or included; blow torches and similar self-contained torches; vises, clamps and the like, other than accessories for and parts of machine tools; anvils; portable forges; hand- or pedal-operated grinding wheels with frameworks; base metal parts thereof: other handtools (including glass cutters) and parts thereof: household tools, and parts thereof: of iron or steel: other (including parts): kitchen and table implements. The general rate of duty will be 3.7 percent ad valorem. The applicable subheading for the spoon/knife/punch will be 8211.93.0030, HTS, which provides for knives with cutting blades, serrated or not, knives having other than fixed blades, pen knives, pocket knives and other knives which have folding blades. The general rate of duty will be 3 cents each plus 5.4 percent ad valorem. The applicable subheading for the two items imported as a set, packaged for retail sale will 8211.93.0030, HTS, which provides for knives with cutting blades, serrated or not, knives having other than fixed blades, pen knives, pocket knives and other knives which have folding blades. The general rate of duty will be 3 cents each [piece in the set] plus 5.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
