Dear Sir: In your letter dated September 7, 2002, you requested a tariff classification ruling. You are requesting the tariff classification on two different sizes of chess sets. The first size chess set is ten inches by ten inches in size and the second set is fourteen inches by fourteen inches in size. Both sizes are constructed of glass, including both the thirty-two chess pieces and the chessboard of each set. Samples of the chess sets were not submitted, however chess sets are specifically provided for in the HTSUSA and samples are not necessary for classification purposes. The chess sets will be classified as games played on boards of special design in Chapter 95 of the HTSUSA. The applicable subheading for the two sizes of glass sets will be 9504.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for arcade, table or parlor games…other: other: chess, checkers, parchisi, backgammon, darts and other games played on boards of special design, all the foregoing games and parts thereof (including their boards)… The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
