Dear Mr. Gavel: In your letter dated September 3, 2002, you requested a tariff classification ruling. You have submitted two samples of twisted 3-strand 50 percent olefin/50 percent polyethylene rope measuring approximately 9 millimeters in diameter. Each of the 3-strands is comprised of fibers made of “nonfibrillated strips.” You do not give any style or item number. It is green in color. It will be used for commercial fishing. The applicable subheading for the rope will be 5607.49.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for twine, cordage, ropes and cables, of polyethylene or polypropylene, other, other, not braided or plaited, other. The rate of duty will be 13.4 cents per kg. plus 7.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
