You submitted samples of both a thermocouple and a band heater, but you have now requested a classification only for the thermocouple. The sample is essentially a wire about 10 feet long. It has a male metal cylinder at one end and two metal spade lugs for an electrical connection at the other end. From the information you supplied, thin wires of two different metals are inside the wire. When the cylinder is heated, the spade lugs will have a difference in electrical potential quite precisely proportional to the temperature difference between the spade lugs and the cylinder. Harmonized System Explanatory Note B-5-ii to 90.25 includes thermocouple thermometers.

You submitted samples of both a thermocouple and a band heater, but you have now requested a classification only for the thermocouple. The sample is essentially a wire about 10 feet long. It has a male metal cylinder at one end and two metal spade lugs for an electrical connection at the other end. From the information you supplied, thin wires of two different metals are inside the wire. When the cylinder is heated, the spade lugs will have a difference in electrical potential quite precisely proportional to the temperature difference between the spade lugs and the cylinder. Harmonized System Explanatory Note B-5-ii to 90.25 includes thermocouple thermometers. The applicable subheading for the sample will be 9025.19.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for thermometers, not liquid filled and not clinical. The rate of duty will be 1.8 percent ad valorem. The sample is being returned to you in a separate mailing. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
