The product to be imported is Type 304 and Type 316 stainless steel cold-rolled quench annealed sheet measuring 2250 mm in length, 1000 mm in width and ranging from 0.4 mm to 0.8 mm in thickness. This flat-rolled sheet will ultimately be used in the manufacture of heat exchangers. This stainless steel sheet, in its imported condition, meets the definition for flat-rolled products in HTS Chapter 72 Note 1. (k): “Rolled products of solid rectangular (other than square) cross section…in the form of…straight lengths, which if of a thickness less than 4.75 mm are of a width measuring at least 10 times the thickness….”

Dear Mr. Herman: In your letter dated April 24, 2002 (faxed to us on July 25, 2002) on behalf of Alfa Laval, you requested a tariff classification ruling. The product to be imported is Type 304 and Type 316 stainless steel cold-rolled quench annealed sheet measuring 2250 mm in length, 1000 mm in width and ranging from 0.4 mm to 0.8 mm in thickness. This flat-rolled sheet will ultimately be used in the manufacture of heat exchangers. This stainless steel sheet, in its imported condition, meets the definition for flat-rolled products in HTS Chapter 72 Note 1. The rate of duty will be 2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
