Dear Mr. Schuckmann: In your letter dated July 19, 2002 you requested a tariff classification ruling on behalf of your client Christian Bauer GmbH & Co. The articles in question are described as steel vanes for use in the manufacture of vane cell pumps. You indicate the finished vane cell pumps will be used in the automotive industry in a system that is used to control the flow of gasoline in non-diesel automotive engines. Samples of the vanes were submitted. The applicable subheading for the steel vanes will be 8413.91.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of pumps of subheading 8413.30.90, i.e., fuel pumps for internal combustion piston engines. The rate of duty is free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
