Dear Mr. Mills: In your letter dated June 18, 2002 you requested a tariff classification ruling. You submitted a sample of an incontinent pad. The pad is made up of three layers. The face layer of the pad is made from 88 percent cotton and 12 percent polyester woven fabric. The middle layer is made from 70 percent polyester and 30 percent rayon non-woven fabric. The third layer is made from a vinyl fabric backed with a polyester knit fabric. Quilt stitching extends through the first and middle layers. The pad measures approximately 32 x 33 inches. The general duty rate will be 9.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
