The article, item 929542, consists of glass candleholders decorated with stars and stripes in the colors red, white and blue. You contend that the glass candleholders, decorated with stars and stripes in red, white and blue, are symbols of the 4th of July Holiday and, therefore, should be classified as festive articles in heading 9505. However, glass candleholders, decorated as noted above, are not considered to be festive symbols for tariff purposes and are not classified within the Festive HTS heading. The applicable subheading for item 929542 will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
