Dear Mr. Roberts: In your letter dated April 29, 2002 you requested a tariff classification ruling. The item in question is a magnetic computer tape, on a reel, which will be used with ADP equipment to record and store data and information on a continuing basis. The magnetic computer tape is prepared for recordation. It does not contain any recorded information or data in its imported condition. It exceeds 6.5 mm in width (sample provided). The applicable subheading for the prepared unrecorded magnetic computer tape will be 8523.13.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for Prepared unrecorded media for sound recording or similar recording or other phenomena, other than products of chapter 37: Of a width exceeding 6.5 mm … Other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
