Dear Mr. Alberdi: In your letter dated April 22, 2002, and received on May 17, 2002, you requested a tariff classification ruling. The photograph submitted, Item #102844, Fun Roller, is a toy inflatable “roller” that is shaped like a mini “tunnel” with plastic walls that allows children to see out and adults to see in. The Fun Roller has wheel like rubber circular openings on each end that allows the roller to roll, and is sized for children so they can roll inside the roller as it rolls along the ground. The item, which is designed for amusing physical activity for children, can also be used in a swimming pool. The applicable subheading for Item #102844, Fun Roller will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
