Dear Mr. Hoffacker: In your letter dated June 3, 2002, on behalf of Big Lots Stores, Inc., you requested a tariff classification ruling. Samples are being returned as requested. The samples submitted are two sets of glass hurricane lamps, item number DD6-2X049/50, that are known as glass tea light holders. The larger lamp of each set measures approximately 5 ½ inches in height with an open top diameter of 3 ½ inches and an interior base diameter of 2 inches. The smaller lamp of each set measures about 4 inches in height with a top diameter of 2 ¾ inches and an interior base diameter of 1 ¾ inches. The exterior of these sets depicts motifs of either snowflakes or snowmen with Christmas trees. The applicable subheading for these glass hurricane lamps will be 9405.50.4000, HTS, which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
