The submitted sample was received broken and was discarded. The article in question, item 179818, is an hourglass shaped tea lamp candleholder. The item is made of glass and comes with an artificial flower that can be placed in the base portion as decoration. A tea light candleholder is placed between the upper and lower portions of the lamp to hold a tea light candle. The candle is not included. The applicable subheading for the tea lamp candleholder, item 179818, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
