Dear Mr. Hoffacker: In your letter dated January 15, 2002, on behalf of Revue LLC, you requested a tariff classification ruling. The sample will be returned to you as requested. The submitted sample, style #745281 is a woman’s jacket composed of a suede front and a knit 70% acrylic/30% wool hood, back and sleeves. The garment has full front zipper closure with and attached drawstring hood. The suede portion imparts the essential character of the garment. The applicable subheading for the jacket, style #745281 will be 4203.10.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for Articles of apparel and clothing accessories, of leather or of composition leather: Articles of apparel: Other, Coats and jackets: Other: Women’s, girls and infants’.” The rate of duty will be 6% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
