Dear Ms. Balice: In your letter dated January 9, 2002, you requested a tariff classification ruling. You are requesting the tariff classification on an item that is described as a bobbing head cat, style 11460. The body and head are constructed of solid plastic material that is covered with textile flocking. A metal screw is inserted into the head and neck of the cat enabling the cat’s head to wobble. The movement of the head in a bobbing motion is the main feature that makes the cat an object of amusement and entertainment. The bobbing head cat is properly classified in chapter 95 of the HTS as toys representing animals. The applicable subheading for the bobbing head cat, style 11460, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: Other.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
