Box 2874 Champlain, NY 12919 RE: The tariff classification of Rec-T-Fire Laser Firearm Rectifier from Canada Dear Mr. Domey: In your letter dated May 16, 2001, on behalf of Rec-T-Fire Canada Inc., you requested a tariff classification ruling on the Rec-T-Fire laser firearm rectifier and parts. The Rec-T-Fire laser firearm rectifier is a laser bore sighter. It is used to align sights on firearms. The caliber-adaptor assembly is placed inside the firearm. By engaging the bolt, the laser module of the Rec-T-Fire’s caliber-adaptor assembly is activated and emits a visible laser dot onto a target. The user adjusts the scope on the firearm using the scope adjustments to attain proper alignment with the laser dot. The caliber-adaptor assembly is unloaded from the firearm and ammunition is loaded into the firearm. The firearm is ready to be fired. The rate of duty will be 3.5 percent ad valorem. The applicable subheading for the parts of Rec-T-Fire laser firearm rectifier will be 9031.90.5800, Harmonized Tariff Schedule of the United States (HTS), which provides for other parts and accessories. The rate of duty will be 3.5 percent ad valorem. It should be noted, however, that parts of articles of chapter 90 are classified in accordance with Note 2 (a) and 2 (b) of chapter 90 of the Harmonized Tariff Schedule of the United States. Parts that are goods of any of the headings of chapters 90, 84, 85 or 91 (other than heading 8485, 8548 or 9033) are classified in their respective headings. Other parts, if solely or principally used with a particular machine, instrument or apparatus of the same heading, are classified with the machines or apparatus of that kind. You have also asked for a ruling on country of origin marking, however, you have not furnished a marked sample, nor have stated how you propose to mark the laser firearm rectifier at the time of importation. In general, country of origin marking must be in accordance with the Customs Regulations, Part 134. The marking must be sufficiently permanent to reach the ultimate consumer and must be legible and conspicuous. If you require a ruling, furnish a sample of the Rec-T-Fire with your proposed marking along with your written request for a ruling on country of origin marking. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
