Dear Ms. Miller: In your letter dated May 8, 2001, you requested a tariff classification ruling. Sample is being returned as requested. The sample submitted is a portable battery-operated cylindrical-shaped lamp of plastic that measures approximately 4 1/3 inches in height with a diameter of 2 1/8 inches. It possesses a red-colored translucent body, containing the batteries, onto which is affixed a top light bulb with reflector that is enclosed within a clear translucent dome-shaped cover. It has a switch mechanism, situated along the length of its body, that when moved upward is designed to raise the interior bulb from a spotlight to a small area lamp or conversely will lower the bulb for the desired light feature.
