Box 330127 Miami, FL 33233-0127 RE: The tariff classification of Gold Pigment from Colombia Dear Ms. Fontana: In your letter dated April 30, 2001, on behalf of your client, Gold Trade Market Corporation, you requested a tariff classification ruling. The applicable subheading for Gold Pigment will be 3212.90.0050, Harmonized Tariff Schedule of the United States, (HTS), which provides for Pigments (including metallic powders and flakes) dispersed in nonaqueous media, in liquid or paste forms, of a kind used in the manufacture of paints (including enamels); stamping foils; dyes and other coloring matter put up in forms or packings for retail sale: Other: Other. The rate of duty will be 3.1 percent ad valorem. Articles classifiable under subheading 3212.90.0050, HTS, which are product of Colombia are currently entitled to duty free treatment under the Generalized System of Perferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on “CEBB” and then search for the term “GSP”. Articles classifiable under subheading 3212.90.0050, HTS, which are product of Colombia are currently entitled to duty free treatment under the Member Countries of the Cartagena Agreement (Andean Group) upon compliance with all applicable regulations. The Andean Group, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on Andean Group, check the Customs Web site at www.customs.gov. At the Web site, click on “CEBB” and then search for the term “Andean Group”. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
