Box 124 Essington, PA 19029-0124 RE: The tariff classification of printed plastic labels from Switzerland. Dear Mr. Zupito: In your letter dated March 16, 2001, you requested a tariff classification ruling on behalf of your client, Precise Technologies. Two samples, described as “labels to be affixed to outer packaging,” were submitted and will be retained for reference. One is a piece of thin, flexible plastic sheeting, approximately 3½” x 6½” in size, printed on one side in 1¼” characters with the brand name of a certain line of disposable sanitary products. The other is a similar sheet of plastic, 6” x 12” in size, again printed with the brand name but also with product information, such as instructions, ingredients, bar code, etc. There is no adhesive on either side of the labels. The applicable subheading for the printed plastic labels of a kind represented by the samples will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) printed matter. The rate of duty will be 1.5%. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
