The garment has two front pockets below the waist that feature a design of flowers and leaves and an exposed edge with no stitching at the bottom hem. The skirt has a textile label on the rear portion of the waist that features the “Sergio Valente” tradename and a metal icon of a bull’s head. A textile label on the left side seam also features the “Sergio Valente” tradename. The sample is being returned to you.

Box 58710 Seattle, WA 98138 RE: The tariff classification of a woman’s flocked skirt from Hong Kong Dear Ms. Monahan: In your letter dated March 2, 2001, you requested a classification ruling. The sample submitted, style number S190292, is a woman’s wrap-style mini skirt that extends from the waist to the upper-thigh area. Examination of the skirt indicates that the garment has a base fabric constructed of a knit 100% polyester fabric. An acrylic adhesive has been applied to one surface of the fabric and then it is covered with a rayon flocking material which forms the exterior surface. The wrap skirt has a full opening that is closed by a right-over left overlay of the front panels. The front panels are fastened together by a one-button closure on the inner right side of the waist area and by a one-button closure on the outer left side of the waist area. The duty rate will be 7.2 percent ad valorem. The skirt falls within textile category designation 659. Based upon international textile trade agreements products of Hong Kong are presently subject to quota restraints and the requirement of a visa. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
