The poncho is constructed of a shell composed of a woven 100% nylon fabric that has a visible polyurethane coating on the inner surface. The poncho is lined with a woven plaid 100% acrylic fabric. The poncho is a pullover garment that has a detachable hood with a drawcord tightening and a slash opening at the neck that is secured by five button closures. The poncho is rectangular in shape, has no armholes and hangs loosely from the shoulders to the bottom hem. The garment has a snap closure on each side opening. The snaps secure the front and rear panels together. The poncho has a large pocket and a textile strap with plastic buckles on the center portion of the front panel. A flap with three hook and loop fasteners secures the pocket. When the poncho is not in use the wearer can invert the pocket, fold the poncho into the pocket and secure it within by the hook and loop fasteners. By folding the garment into the pocket it allows the wearer to pack and carry the poncho using the textile strap. The packed poncho may also be used as a stadium seat. Box 672 27 Imrie Street Randolph, MA 02368 RE: The tariff classification of unisex packable poncho from China Dear Mr. Pransky: In your letter dated February 23, 2001, you requested a classification ruling. The sample submitted, style name “Sport Utility Poncho”, is a unisex poncho that extends to the knee area. The poncho is constructed of a shell composed of a woven 100% nylon fabric that has a visible polyurethane coating on the inner surface. The poncho is lined with a woven plaid 100% acrylic fabric. The poncho is a pullover garment that has a detachable hood with a drawcord tightening and a slash opening at the neck that is secured by five button closures. The poncho is rectangular in shape, has no armholes and hangs loosely from the shoulders to the bottom hem. The garment has a snap closure on each side opening. The duty rate will be 7.2 percent ad valorem. The poncho falls within textile category designation 635. Based upon international textile trade agreements products of China are presently subject to quota restraints and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
